中国人的“年味”，体现在活色生香的食俗里。享尽天南海北的“硬菜”后，汤圆开始登上餐桌“C位”。

临近元宵节，每天凌晨四五点钟，“中华老字号”武汉五芳斋门口就排起长队。食客翘首以盼，等候汤圆出锅。

1946年，以跑船为生的江苏人倪锦财落脚汉口，成立武汉五芳斋，经营江浙风味的汤圆。发展至今，五芳斋在武汉已是三镇皆知、远近闻名；武汉“五芳斋汤圆”也被认定为中国名点、中华名小吃上海新茶资源。

正如豆腐脑有“咸甜之争”，汤圆的吃法也有地域之分。

“按叫法，南方叫‘汤圆’，北方叫‘元宵’；按做法，南方包汤圆，北方滚元宵；按口味，有甜有咸。”武汉五芳斋汤圆制作技艺市级代表性传承人李杰告诉中新社记者。

广东有四式汤圆、贵州有鸡肉汤圆、上海有擂沙汤圆，而五芳斋的黑芝麻馅叠式汤圆则是“老武汉”的心头爱。

李杰说，叠式汤圆如此受欢迎，在于两大法宝：一是制馅，二是制面。取适量芝麻、些许猪板油，辅之以白糖、橘皮，揉搓成馅心。猪板油来自东北，当地猪膘厚一点，油脂好一点，更能提香。面皮选用上好的糯米粉，用水磨吊浆工艺使其口感更加爽滑。

叠式汤圆，“叠”为重头戏。据李杰介绍，按照传统做法，把馅心和糯米粉铺在簸箕上，端起簸箕“摇团”，类似农村的筛糠。再在汤圆上洒上冷水，继续“摇团”。如此反复多遍，汤圆越摇越大爱上海419。如今，自动化机器代替了手工“摇团”——只需将馅心倒进装有糯米粉的机器大锅中翻滚，再蘸水打湿，层层叠加16次，一颗颗直径约3厘米的叠式汤圆就出锅了。

党的二十届三中全会《决定》提出“探索区域协同立法”，这是党在深化立法领域改革方面提出的新要求。之所以提出这样的要求，是因为近年来，各地有了越来越多的区域协同立法的实践经验需要总结爱上海官网。特别是2015年修改的《中华人民共和国立法法》增加了设区的市具有地方立法权的条款，使区域协同立法的主体除了31个省、自治区、直辖市以外，还有323个，包括289个设区的市、30个自治州和4个未设区的地级市上海新茶网。这也意味着区域协同的地方立法需求和立法数量，在可以预见的未来会大增。

中央与地方的关系

区域协调发展，离不开立法保障。党的二十届三中全会《决定》提出“推动京津冀、长三角、粤港澳大湾区等地区更好发挥高质量发展动力源作用”。除了上述三个地区以外，党的二十大和二十届三中全会提到的贯彻国家区域协调发展战略的区域还包括：西部地区、东北地区、中部地区、东部地区、革命老区、民族地区、边疆地区、长江经济带、黄河流域、雄安新区、成渝地区。而涉及的协同发展事务不仅有流域环境治理、大气污染治理、生态保护、文化遗产保护、区域交通一体化，更有人口流动、公共服务均等化、能源结构、产业转移升级等经济社会各个方面。目前，京津冀、长三角、粤港澳大湾区已经初步建立了协同立法工作机制。在可预见的未来，上述其他区域也将逐步建立完善协同立法工作机制，制定更多区域协同相关议题的地方性法规。简言之，区域协同立法，旨在降低区域协调发展的交易成本，从而更好地贯彻区域协调发展战略。

目前区域协同立法的基本形式，分为省内区域协同立法和跨省区域协同立法。前者如广州、佛山有关城市轨道交通管理的协同立法的条例，后者如湖北省恩施土家族苗族自治州、湖南省湘西土家族苗族自治州有关酉水河保护的协同立法的条例，以及贵州省、云南省和四川省有关赤水河流域保护的协同立法的条例。当然，如果制定地方性法规不成熟，也会采取决定的形式，例如，长沙、株洲、湘潭三市人大常委会同步出台《关于推动和保障长株潭一体化高质量发展的决定》。但区域协同立法并非指上述两种特定的共同立法形式，即相关地方都通过相同法规、相同决定或相同条款。强调区域协同立法，还意味着某一地方在制定相关地方性法规时，应当考虑法规的外部效应，即对其他地方会产生什么影响，故须征求其他地方的意见。

地方性法规的外部效应，意味着在涉及国家利益或中央职权时，还需要中央有关方面进行指导。例如，《河北雄安新区条例》在制定过程中，也多次主动向全国人大常委会和有关国家机关请示报告。实际上，不少区域协同立法事项，都是落实中央的重大决策。例如，为贯彻中央通过的《京津冀协同发展规划纲要》，京津冀三省市人大常委会分别通过了《机动车和非道路移动机械排放污染防治条例》。粤港澳区域协同立法也应以中央通过的《粤港澳大湾区发展规划纲要》为基本指南。此外，如果某些立法事项涉及的区域过多，就需要中央有关方面直接主导协调制定。例如，长江保护法、黄河保护法就是由全国人大常委会通过的。在这个意义上，为保护珠江而立法，由六省区（珠江是中国境内第三长河流，跨经云南、贵州、广东、广西、湖南、江西6个省区）进行协同立法的成本会很高。因此，更需要由中央有关方面来协调制定珠江保护法。简言之，区域协同立法是地方立法事务，也是中央立法事务。为此，《法治中国建设规划（2020—2025年）》明确提出“建立健全区域协同立法工作机制，加强全国人大常委会对跨区域地方立法的统一指导”。

利益均衡与分工合作

探索区域协同立法，不能单纯追求通过协调共同通过了多少部地方性法规，而是要建立有效的区域协同立法工作机制。建立有效的区域协同立法工作机制，不仅是在形式上建立各地人大常委会之间的区域协同立法工作机制，更要在实质上有效协调中央与地方的关系、区域之间的地方利益以及立法与行政、司法的关系。在形式上，以京津冀为例，三省市共同出台加强协同立法的若干意见、人大法制工作机构联系办法、立法项目协同办法、立法项目协同实施细则、构建协同监督机制实施意见等五项制度，并且建立了联席会议、协商沟通、立法规划计划协同、法规常态化清理和学习交流借鉴等工作机制。

在协调区域之间的地方利益方面，难度就更大。虽然区域协同立法的主体地位平等，但按照区域发展原理，每一个较大区域都有中心与边缘，因此需要统筹兼顾，形成利益均衡的格局。区域首先是指经济区域，经济区域则是因流域而形成。知名学者冀朝鼎和施坚雅都有过深刻判断。前者指出，中国历史上的基本经济区是与水利事业的发展密切相关；后者则指出，每一个大区经济都是在依流域盆地所限定的地理大区中被形塑的，并被包含在其中上海各区新茶工作室。而行政区划又并非按照流域而划分，行政区划与经济区域就呈现出犬牙交错的格局。因此，区域协调就得突出重点，不能搞平均主义。例如，京津冀区域协同立法，就是以北京为中心；长三角区域协同立法，就是以上海为中心；对于大湾区来说，区域协同立法存在多中心，《粤港澳大湾区发展规划纲要》就提出“发挥香港—深圳、广州—佛山、澳门—珠海强强联合的引领带动作用，深化港深、澳珠合作，加快广佛同城化建设，提升整体实力和全球影响力，引领粤港澳大湾区深度参与国际合作”。区域协调还得利益兼顾，优化转移支付制度。再以珠江保护立法工作为例，广东省是下游地区，为了保证广东的经济社会发展，就需要对上游地区进行生态补偿，将已有的生态补偿机制用立法形式确立起来。如果涉及各省利益，地方之间难以协调立法，这就需要中央介入指导。

大湾区区域协同立法的特别工作机制

如前所述，由于粤港澳分属三个不同法域，大湾区的区域协同立法较之国内其他区域难度更大。对此，党的二十届三中全会《决定》提出“深化粤港澳大湾区合作，强化规则衔接、机制对接”。就现有经验来看，一方面，法学界一直在尝试制定涉港澳的相关民商事示范法，可以继续研究，推动民商事示范法成为实务中的民商事惯例；另一方面，广东省司法厅、香港特区政府律政司和澳门特区政府行政法务司已经联合制定了《粤港澳大湾区跨境争议调解示范规则》。示范规则是由公权力机关制定，但并无强制力，供实务参照和自愿采纳，具有准立法性质和软法的特点。此外，还可由最高人民法院出面制定规范性文件来协调大湾区法律适用、强化规则衔接。由此，大湾区在一时难以建立区域协同“硬法”的情况下，可以力求建立有效的区域协同“软法”工作机制。
